The S.M. delivered judgement on Tuesday at Palmerston in the case Donald Grant v. F. Pirani, and after reciting the clauses in the lease said : — The only conclusion I can come to after considering the above mentioned covenants, is that the word "lessor" is a clerical error, and should have been " tenant," and that by striking out the words referred to it was agreed that if the tenant failed to insure, the landlord should not be entitled to claim the amount from the tenant with 10 per cent, added, but should be left to his remedy under the lease tor breach of contract. In this case the tenant did not insure, and the landlord insured in his name, paid the premiuma, and now claims money from the tenant so paid. I hold that the landlord's remedy against the tenant for not insuring was to determine the lease for breach of contract, and that he cannot now recover the premiums paid, and must be nonsuited on this part of his claim. With regard to the repairs however, I am of the opinion that the plaintiff is entitled to recover, and I assess the amount at £3 15s 6d, tor which sum I give judgement tor the plaintiff with costs 17s, witnesses £z 13s, solicitor £1 ss. Notice of appeal was given on behalf of plaintiff.
