0 We published the other day a report on the Wanganui case as to Nuis ancea on roads, where Jadge Kettle held the defendant, Mr A. E. T. Nixon, not liable for a penalty sued for by the Wanganui County Council for failing to olear the gorse off a public road, Judge Kettle holding that the Act relied on was not retroactive. This judgment was appealed against but we find that the Chief Justice has dismissed the appeal, therefore upholding Judge Kettle's decision. As we said previously this ruling is of very much importance to public bodies, as unless it can be shown that the gorse spread on to the road since the Act was passed in the year 1894, no occupier of land can be compelled to clear ib away. The case is of interest also to all those who expended the money in clearing gorse under the orders of local bodieß, as if their order was illegal they should be called upon to refund the expense they put on the occupier by threatening fines and other penalties if they failed to carry out the orders issued.
