Palmerston District Court.
FBIDAY. (Before His Honor District Judge Kenny). STOBLET V. OSBORNE. In this case the plaintiff claimed £400 damages for malicious prosecution, having been arrested in Palmerston at the instigation of the defendant. The trouble arising out of a cheque signed by Daniel Jamieson, and cashed by the plaintiff, who being in need of money, got Mr Osborne to cash it for him. The following jury were empannelled ; — Messrs Gilchrist (foreman), Jl L. Barnicoat, S. Abraham, and J. J. Gaustad. Frederick Stub!ey, plaintiff, and constable Salmon gave evidence as to the manner in which the information was laid. Mr Innes, for the defence, asked His Honor to nonsuit the plaintiff on two grounds, first that his client was not the actual prosecutor, the police having laid the information, and second that there had been no favourable termination of the prosecution, and quoted authorities in support of his contention. Mr Moore, in reply, authorities to show that even the mere taking oat of a search warrant made one liable for malicious pro* secution and the defendant in this case had gone a great deal further than this.
