(Before Distriot Judge Kettle.) Fbipay. In re Archibald Kerr — Public Examination. Mr Hawkins for debtor and Mr Oooke for Mes3ra Bichter Nannestead and Co. Debtor said he commenced business as a baker at Foxton in 1894. Paid £80 for the business and carried on until he was bankrupt. Had £80 in caßh when he started. Owed Bichter and Nannestad over £300 for flour. First knew he was insolvent in August, 1894. Told Mr Nannestad his position and was promised assistance. He was purchasing all his flour from the firm. Filed as soon as Mr Nannestad declined to assist him longer. Sold out his business before filing. Before doing so he asked Mr Nannestad for ft cheque to assist him to meet a bill. Mr Nannestad refused and debtor went back to Foxton and Bold out to a man in his employ without consulting his creditor?. The amount agreed on was £50 11s 6d. There was no written document. He filed nine days after the gale. Received £16 in cash and from this he paid £10 to his solicitor and the balance for his personal expenses. To Mr Hankins : Mr Nannestad asked him to reduce the price of bread, but he declined. Considered he was simply selling Nannestad's flour. Bid not make a profit on his business because of the opposition. To His Honor : It did not occur to him that he should not have sold out without conferring with his creditors. He never gave the matter » thought. The examination was declared olosed.
