A Totalisator Case.
At Wanganui on Monday a case was before the Court in which plaintiff sued to recover a proportion of a totalisator dividend. It appears that a party had made up a ticket on Flying Shot in the race won by Sedgebrook. Owing to the Jatter's disqualification, the dividend was paid on Flying Shot, but the holder of the ticket over whioh the action arose immediately after the race destroyed the ticket. The plaintiff claimed that defendant was liable for the value of the ticket. In the course of his judgment, Mr Kettle, S.M., said that he was inclined to the opinion that the plaintiff was not entitled to sue in any Court, the intention of the legislature being that the courts of the Colony were not to be open for the investigation of such disputes. The jplaintiff would be nonsuited with court costs 39, witness' expenses 14s, and solicitor's lee £1 Is.
