Otaki Licensing Committee.
* ■— The adjourned meeting of the above Committee was held *fc Ofc'aki yesterday atf 10 a .m . Tresen t— Messrs H. W. Brabant, S.M. (chairman), Williams, Thynne, Stu.ckey, Gascoigne, Barnett, McCulloch, Bennett and Smith. The hearing of the application of J. G. Campbell for the transfer of his license from Manakau to Levin w£s resumed. Mr "Gully appeared again for. the objectors and raised the point, quoting authorities, that it was not within the power of the Committee to grant the transfer to premises not in existence. He also called oertain rebutting evidence as to the need of ' aft extra house in Levin. Tha Committee adjourned the Court for consideration of the case which took them over one hour. During the consideration one member mentioned that the Licensing Act had specially ordered a Stipendiary Magistrate to be Chairman in order to keep the Committee within the limits of the law, and be 'therefore desired the chairman to express his opinion as to Mr Gully's contention. Mr Brabant said that being thus called upon he was bound to do what was asked and he was in accord with Mr Gully and he believed the Committee had not the power. In direct opposition to this it was moved that the transfer be granted at the next quarterly meeting, pro* vised a house is erected to the satisfaction of the Committee, to which an amendment was proposed that the license be not transferred, but 'such an appli.Qaiionsviould.be fetourably entertained when the needs of the town showed a. house was necessary. Foe the amendment Messrs Harnett, Williams, Thynne and McCulloch voted, and . i Messrs Brabant, Stuqkey, Bennett, Gascoigne and Smith against it.
The amendment was thus iosi Ort the motion being put it was lost by the votes of Messra Brabant, Tbynne, Williams, McCulloch and Harnett. It was then proposed and carried by 5 to 4, (the members Who voted against the above motion voting) that the application be refused; .. TM Court Was then", opened and the applicant informed that his application was refused by a majority of one. The opposition to granting the transfer to M* McLeod for the Shatij&on Glub Hotel was then en* . tered;;into; .■■,■<[ ;■ " i[A fuller report - will appear next issue.] ; ' The result of the Committee's deliberation being That the transfer be granted conditional upon the applicant, Mr McLeod, exercising more care in the future than has been taken in the past.
