Wanganui District Court.

(Before Mr District Judge Kettle.) Tuesday, 18th September. James Bailey appeared to answer the following charges : — That on 12th April, 1894, and within twelve months before the presentation of a bankruptcy petition against him he made preparations for quitting New Zealand, and for taking with him part of his property to the amount of £20 and upwards which ought by law to have been divided amongst his creditors, with intent to defraud. And further that he did afterwards quit New Zealand, and take with him part ot his property to the amount of £20 and upwards, which ought to have been divided amongst his creditors with intent to defraud. Tbe accused pleaded not guilty The case was conducted by the Crown Prosecutor, Mr S. T. Fitzherbnrt, and the accused was defended by Mr D. Hogg.

After hearing the evidence, the jury retired to consider their verdict, arid tliree minutes, later., returned . • Mr Hogg then applied that probation should be granted, but His Honor said he did not consider it a case where the Act could be applied. The prisoner was then addressed by His Honoi\ wild said that sUcti conduct as lie had been found guilty of was discreditable and disgraceful; He considered .a fairly substaritial sentence in this case riiust be lh lflicted—for . this 4 kind , must, be stopped.
