Dudson last week about selling my interest in the mill ; told him I wanted £20 cash ; Jonas was at mill from 28th June to 7th July. The defendant further explained that he told Jonas he wanted a cook ; had paid Tos £35 on the under • standing that he got a month's credit ; Jonas volunteered the cash. The Magistrate said the case had better be heard in the usual way. Williain Jonas deposed — Defendant oh 25th June asked him to cook ; he declared he was never in a better position before as the workmen had all given him a clean sheet ; he had f tons dressed fibre and 8 tons to come in ; he only owed Joe Tos, he however did not intend to pay him unless he gave credit ; I objected to so much credit and offered to find cash for rations until fibre was shipped away ; defendant said I should have my money by the first

shipment ; Tos was told if he would give a clean receipt for £35, cash would be paid for the future ; Tom* linson would not pay the £35 until J came in and paid £15 odd for goods ; I was cooking at the mill about a fortnight and paid for the man who worked in my place for a week ; defendant told me he was getting £11 a ton. By Mr Innes : Tomlinson knew I got the goods on the 27th ; under S.tOQd I was engaged by the week at "good" wages; left without any notice.

P. Hennessy deposed— Recognised account ; the goods were put into defendant's dray for Wirokino mill ; Jonas paid the account.

James Liddel deposed as to paying the £85 and the ordering and paying of further goods to the amount of £15 odd; remembered Jonas purchasing goods- to the value of 16s j^j^e said they were for the mill, Mr Inn,es : The orders for the £15 worth of goods were some 7 or 9 and signed by Tomlinson.

Judgment was agreed upon amounting to £81 103 Id; costs, 893 ; solicitor's fee, 525 ; 2 witnesses, 2s 6d and 4s.

In. the evening before the S.M., a settlement was arrived at by Mr Innes offering on behalf of the defendant an order on Mr Sncdgrass for £15 and £7 a month until the amount was paid.

After considerable conferences between all parties Mr Kay finally accepted the offer, and an order was raade accordingly.
