(Before H. W. Brabant, Esq., 8.M.) TIITTRSBAY, 12t!T ApKTT,. CIVIL. T. Ennis v. Taiawhio— Claim £4 19s. The defendant disputed the 19s. He said he had paid 20s and the suit was to cost £5. It having been explained to defendand that 14s was for costs in a previous summons, he admitted it. The plaintiff agreed to take the 5s off the suit. The defendant said the plaintiff had the vest and trousers. Plaintiff said they were ready and could be delivered at once. He would not let them go without the money. ' • -The- S,M. pointed out that the summons' was for a suit of clothes L made and ' supplied, which it was plain had not been' delivered. After an explanation by ; either side, judgment was given for £4 14s and costs 14s, interpreter's fee 11s 4d ; execution not to be issued without leave of the Court. J. Andrew v. Richard Gray — Claim £4 10s 6d. It appeared that the dispute was as to the rate of pay per day. Plaintiff deposed — I was to get 7s a day, defendant told me so when he' engaged me." "By defendant— Bemembered saying- 1 : wanted a" 'regular job ; you said you could pay 6s a day all the yeaxye&9^iß iHha4>j!iaj;]if feu. jyoyld give 6s a day all the year round I would ... take it ; . ; yoti said you : would let me know;, you did promise me the. job: and' I. made no answer; I said "Very welh" I accepted the proposal on the" conditions that I should huve' -the work all the year round ; about the first week in February you asked me for my time and I told you how much it was. By S.M.- Never understood I was engaged at 6s a day. Richard Gray said during a conversation with plaintiff he had said he would take a regular job at 6s a day ; when plaintiff was giving in his time he gave it to defendant as
7s a day for the first week and 6s a day for the remainder of the time. By S.M. — Made no agreement to pay every month. Was not aware that wages must be paid at the end of every week unless otherwise arranged. Judgment was given for plaintiff for amount claimed and costs 6s.
