The Sydenham Licensing Appeal Case.
Argument in the case of Isitt and others v. Yuill i 3 bring heard in -Wellington. This is an appeal from 'Judge Denniston's decision in the •Sydenham licensing case in granting a wjsifc of eertiorari on the ground of prejudice and bias, to quash the certificate of the Sydenham Licensing';■'' Committee •in .refusing the renewal to Lancaster Park Hotel. The Court refused the preliminary 'application by Mr Cooper on behalf of the appellants to file additional affidavits; . Mr Bell, for the respondent, con eluded bis argument yesterday afternoon!" He contended that the Coin mittee had proved itself incompetent 10 exercise judicial discretion, first by the 'pledges it gave at the election, secondly by its conduct after its election and before this question came before it, thirdly by its conduct in dealing with this question, anH fourthly by its subsequent coifduct. He did not say a blue ribbon man or a prohibitionist was disqualified from sitting on a Licensing Bench, . but submitted that a member of the. Sydenham Prohibition Leage, who was pledged to close all publichousesin Sydenham, was disqualified, at all events from sitting on the Sydenham Licensing Bench.
