Jobn Patemnn Harcourt (land broker) v. James Lindsay Oliver (sheep farmer)-— Cu'im, £283 8s 9J, commission on the sale of certain properly at Motoa, Wellington district, being at the rate of $U per cent on £9332. The plaintiff alleged that ill February last de. fendant instructed him to sell his sheep farm at Motoa, and agreed to pay 2% per cent commission ; that ho founl purchasers for the property, viz ; James Allen Strang, and David Walter Strang, who paid defendant £9332 ; and thai defendant ro fused to pay the chim for commission. The defence was that the property had been sold through the ageucy of Murray, Roberts & Co., who had been paid commission. Mr Travers appeared for the plaintiff, while defendant was represented by Mr Skerrelt (instructed by Mr flankins oi Pahnemon. North). After evidence had b en tak=n His Honor giivo judgment for defendant with costs according to scale. — N.Z. Times.
