The Foxtori Slander Case.
+—■ ■■ — Mr Baker appeared at the District Court this morning on behalf of the defendant in the case of Fraser v. Imrie, aud asking for an order, to be i made staying execution. . ; The plaintiff was represented by, Mr Bay. • "A ! Mr Baker said he had only received his- instructions late on Saturday evening: and His Honor bavjbg \o go ( a Way from the town he was compelled , to make the application at a short notice. He said there was provision in the Act enabling the Court to stay execution until an application for a rehearing could he made, but if the Gourt would allow the application for a Rehearing to be taken -on the 4th, this motion could be allowed to stand brer. ' ' His Honor said if it would be for the convenience of the parties be would take the application on the evening of the 4th and thus avoid the question of staying execution. Mr Bay consented to this courso on notice and affidavits being served on him not later than Wednesday, 4th ultimo. The application of re-hearing will thus be heard on the evening of the 4th August. Wh understand the grounds of application are that fresh evidence has been obtained since the, judgment, and that the defendants complain that the case was given "into the hands of counsel whom they had had no opportunity of instructing, Mr Hanking, who was instructed being absent. — Standard. \
