Interesting to Newspaper Owners.
A case of considerable interest to newspaper proprietors was tried in the local Small Debts Court, Alburjr,
tf.S.W. S. Hawkins*. proprietor of the Wagga Wagga Express, sued Charles M 'Govern, soap manufacturer residing at Albury, ior advertising his soap for fifteen months. Plain* tiff stated tha' the orde- for adver* tising wa->;nv en verbally, and that he understood the advertisement wai to remain in the paper. until countermanded. *t th« end of the first qu rter the bill was sent f in, »nd it was again rendered from time to time afterwards, but no notice ws tak n. f >efe jdant s ated lie hid only ordered the advertisement for one quarter, andjhad not been aware that it wag being continued. The police magistrate said it had been ruled that any one receiving a newspaper, even if not ordered, was liable for payment onless he sent the paper back. He eon' sidered the same rule applied to advertising. Defendant had been in* formed of his advertisement being in the paper by means: of the. accounts from time to time rendered, and he should have paid up and . counter* manded the advertisement at the end of the first quarter. Judgement was given for plaintiff.
