THE BAINESSE CASE.
From the Evening Post of Thursday we extract the following particulars of the Magistrate's decision in reference to the charges brought by Mr Mace against Messrs C. Simpson and M'Lennnn, in connection with the sale of the Bainesse cattle : — Mr Davy said — I have considered the evidence in this case from every point of view that has been suggested, and I have considered it very carefully. Audi can only come to the conclusion that there is no reasonable probability that this charge of conspiracy could be sustained. So far as I am concerned, at all events, I think the matter ought not to go any further, and I therefore dismiss, the information. / The Hon. Mr Buckley — Does your Worship give the usual certificate in cases of this kind ? Mr Gordon Allan — And the costs, too? Mr Davy — I think the certificate only applies to summary cases, doesn't it ? At all events, I should not be inclined to interfere even if I had • the power, for I am certain that the accused themselves would be only too glad to see the matter out if there was anything further in it. Mr Gordon Allan — And cnnnot your Worship allow costs? Mr Davy— -I don't think I ought * to interfere, and say anything about the costs. Whatever I may think about the conspiracy, there is no doubt that the circumstances attending this transaction have been very unfortunate, to say the least of them.
