FOXTON LOCAL BOARD

Monday, Avriu 12, 1880. The Board met at the Athenaeum on Monday last, at 7.30 p.m. Present— Messrs. Gray (Chairman), Loudon, Easton, and Coloy. The minutes of the previous meeting were read and confirmed. CORUESPONDENCE. Telegram read from W. W. Johnston, Esq., M.H.R., re Foxton railway deviation and reclfimation works. Received. Letter road from Treasury, stating t'lat the sum of £113 los lid had been placed to credit of the Board, being subsidy for half year ending 30th June, 18S0 ; als:>, from agent of Bank of New Zealand on same subject. Received. Letter read from Mr A. J. Whyte, resigning hi 3 seat on the Board. Received. The tenders of Messrs Feck and Tricklebank, for erection of brick culvert on Avunue road, were reported to the Board. UESOLUTIONS PARSED. Propisotl by Mr Loudon, seconded by Mv Coley: "That it is the intention of this Board on the 28th d..y of A.pril. 1880 to strike a r.ito of one shilling in the £ on the annual rateable value of all properties within the Fnxton Local Board district; such rate to be for tho period of one year, commencing April 1, :BSO, and ending March 31, 18SI, to bo due and payable on the 2!)lh day of April, 1880, at the office of the Board, and that the rate book will be open for inspection at the oflice of the fionvd until the 28th day of April, 1880 ; notice to be published in tho Manawatu Hekai.i)." Carried. Proposed by Mr Easton, seconded by Mr Loudon : ." That tenders be failed for clearing out the drain from the Racecourse Hill to ssction No. 0.58, being about 50 chains, more or less." Carried. Proposed by Mr Easton, seconded by Mr Col y : " That tenders be called for clear ing out. about 50 chains, more or loss, of the drain on "NTo. 1 Line of road, and that Messrs Ooley and Easton be a committee to dicide as to what additional work be included in the specification." Carried. Proposed by Mr Easton. seconded by Mr Coley : " That tenders be called for clearing the road and digging the drain on Steven's line, being about 36 chains, more or le-s." Carried. Proposed by i\lr Loudon, seconded by Mr Coley : •• That tenders bo called for making a drain and clearing road opposite Norbiton, 44 chains, more or less." Carried. Proposed by Mr Easton, seconded by Mr Coley : " That tenders be called for clearing out the drain on Moutoa road, and repairing the culvert and forming the footpath, ab^ut 7 chains, and coveriug in same drain with culvert to section No. 128." Carried. Proposed by Mr Loudon, seconded by Mr Coley : " That Messrs Coley and Easton be a committee to inspect and report on the road line leading from Cameron's corner, thence along the Lady's Mile to Mr Robinson's gate, and send in their report to next meeting of the Board." Carried. chairman's disqualification. Mr Loudon laid ou the table the following legal »piniou by Mr W. S. Staite, of Palmerston, re the alleged disqualification of Mr A. Gray : — "Palmerston North, 2Gth February, ISSO. F. Loudon, Fsq Dear Sir — lie Mr Gray's disqualification The opinion, as given in the paper forwarded (Manawatu Herald) seems to be correct. My only doubt is on the question whether Mr Gray was a member of tho Board when the contract was made. If not, Ido not think lie would be disqualified, as the words of section 1G are, " If any Commissioner shall become ;" and the disqualification clause does not refer to contracts. Yours truly, Wm. S. Staite." Proposed by Mr Loudon, seconded by Mr Eastou : " That the Clerk be instructed to make a copy of the minute of the 2nd June. iWi, and forward it to Messrs dmolly and Pi* r, solicitors. Wellington, together with a copy of the Ifith clause of the Local Boards Act, and ask their opinion whether or not Mr Gray is disqualified from being a Commissioner of the Local Board." Carried.
