Ah Important Case. — 'An important de* oiaion was given by the Supreme Oourt at Wellington on Friday last. A man named Gleioh, an absconder from Adelaide, was arrested a tew days ago at Wellington, aud ordered by Mr Manaford to be sent to Adelaide for trial. Mr Gordon Allan, on behalf of Gleich, moved the Supreme Court to quash the decision of the Magistrate. Five Judges were in Wellington at the time, and four held that he must be discharged, one only dissenting. Judges Prendergast. Johnston, Richmond, and Williams, held that the Governor had no power to sign a warrant to hold a man in custody after he had passed the confines of the oolony, hence Gleich could not be detained in custody whilst travelling en the high seas between New Zealand and South Australia ; further they held that as the man could not be legally deported, the warrant under which he was detained must be bad, and he must accordingly be discharged. Judge Gillies disagreed with the decision. This certainly leaves matters in an unsatisfao' tory position. Until the Imperial Parlia. ment has legislated upon the question, it ,
