AUCKLAND, Sept. 30. Mr Justice Herdnaan heard argument on an opplieation for a writ of haheas corpus in tlie ease of William George Cavenett, sentencecl hy Afr Hunt, S.A'h. to twiO months ' imprisonment on one charge and one month. 011 a second,' in the course of which the Judge remarked to Mr MeVeigh (for the applicant) : '•'You say that the Miagis! rate penalised the mon, not because lie sold an axe, but because lie w?as going* to appeal?" Mr MeYeigh: ' ' Yes; that is just what it is."' He moved that the prisoner be discharged from custpdy, and that a rule -nisi for haheas corpus be granted. After h ealing Mr Aleredith, who suhmitied that the Afagislrate's action was quite proper, His Honor said he would take timo lo consider the matter.
