Jn 1923 John Nieholas Gamblin, of New Plymouth, died, leaving liabilities of the Bank of New Zealand of Wrae £38,000'. The deoeased left eertain property mortgaged to the Bank, but it was elearly not sufficient to satisfy the whole debt to the bank, and the question is whether - under the mortgage the bank ean claim satisJ'action out of the remainder of the estate left by ihe deeoased^hut not mortgaged to the bank, and whether the bank is entitled to .satisfaction of the whole of the amount owed to it.
