ALLEGED LARCENY.

At the Police Court, Inyercargill, o] Tuesday last, Thomas Wilson was chargec on remand with haviug on the 'Jtl January, at Wyndham, stolen a bank de posit receipt for L6O. — W. H. Calej deposed that while at Wyndham on th< sth J anuary he stopped at Boyd's Rail way Hotel. Gave Mr Boyd his swag t< take care of. In the swag was a pockei book containing among other things c bank deposit receipt on the Bank of JN e\* Zealand for L6O. Took the swag awaj on the 12th January, when it seemed tc be in the same state as when he left it. Did not open it till the 17th, when he found that the bank deposit receipt had disappeared. Went to the bank at Wyndham and made enquiries. The receipt produced was the one he had lost. — Donald Boyd deposed that Caley had left his swag at witnesses' hotel about the time in question. Witness put it in a corner of the dining room. When the prosecutor got it four or five daj r s afterwards it seemed to be the same as when witness had left it. Knew the accused. He had been about the house at the time. ~R. B.T. Miller, at the Bank of New Zealand, Wyndham, deposed that the prosecutor had lodged L6O on the 6th December last and got the deposit receipt produced. On ilie 11th January the receipt was presented at the counter of the bank by the accused. Witness asked him what he wanted, and he said he wished the money. Asked him to put his name on the back, and he said that being partly drunk he would not be able to write his name. Witness told him he must put somethiag on the back or cisc come back Avhen he was sober, whereupon he said he could not write. He afterwards said the receipt was not his. Witness took the receipt to the agent, Mr Fraser, who told the accused that the name on tlie receipt was Caley. Accused then said that Caley was his name, although he had previously given that of G-itton. After being told that he would have to prove himself Caley, the accused left the bank. He objected to par t with the receipt, but Mr Fraser declined to giveit up to him. Didnotagain call at the bank. — Detective Ede deposed that he arrested the accused on the 20th inst. in Spey street, InvercargilL On the warrant being read to him accused said he had got the receipt from his brother at Fortrose. — The accused, who had not questioned any of the witnesses, said he was drinking hard at the time, and did not remember anything of it. He wished the Court, to deal summarily with the case. — He Worship said he did not think he could. [Remanded ! till Thursday morning, when he was committad for trial at the next sitting of the Supreme Court.
