MACKLIN F. EDUCATION BOARD
Our Wellington correspondent telegraphs :—“ At the sitting of the Supreme Court in banco this morning, in the case of Macklin v. Marlborough Education Board, the appeal was dismissed by Mr Justice Richmond with costs.” It will be remembered that Mr Mclntire, our local magistrate, gave judgment against the Board, when some of the creditors took a number of legil opinions upon the question, after receiving which Messrs Girling and others offered and agreed to pay all costs if the Board would appeal, and enclosed a cheque for L 25 as part payment. The Resident Magistrate’s decision has, however, been upheld, and the opinion given by Messrs. Conolly and Rogers has been confirmed by the learned judge. The appeal was argued before Mr Justice Richmond, at the Supreme Court sittings recently held here, when Mr. Sinclair, for Mr McNab, appeared for the Board, and Mr Rogers for Mr Macklin, and His Honor intimated that he would give his decision in Wellington, which has accordingly been given this morning as above.
