RESIDENT MAGISTRATES’ COURT.
Blenheim, Monday, Dee. 13. (Before H. Mclntire, Esq., R.M., and T. Redwood, Esq., J.P.) w. E. fiIRLINCI I’. H. WILSON. This was a judgment summons for L 8 6s 10d and stood over from a previous day. Mr Sinclair applied to the Court for an order. The facts were admitted hut it waH alleged that the defendant being a bankrupt, a warrant could not be enforced against him without the leave of the Bankruptcy Court. Mr Sinclair said he was quite willing to take an order on such terms. He quoted a case tried at Nelson before His Honor Judge Broad, bearing on the case. Defendant was a carpenter earning 10s per day. Mr Rogers contended that the Resident Magistrate’s Court had no power to grant the°order prayed for unless with leave of the higher Court previously obtained. The Court granted an order (conditionally on leave of the higher Court being obtained) for payment of the amount by instalments of LI per month, or in default three weeks’ imprisonment. E. ADAMS V. M. CARROLL. This was a judgment summons for Ll2 19s lid. Defendant was examined as to his means and ability to pay what was due, and said he would pay if he could but he was not in regular employment and bad a family to keep. He did carpenter’s work when he could get it, but last week lie only earned twelve bob,” and he had a wife and five children, whose ages ranged from 4to 14 years. If he could get constant work he would pay. He was willing to pay half-a-crown a week but could not do more. The Court made an order for payment of the amount claimed at the rate of 2s Gd per week, or in default three weeks’ imprisonment. There were one or two other cases on the list but they were settled out of Court.
