THE KAIMAI CATTLE THIEVING CASE.
Accused Fbund Guilty. At the Hamilton Supreme Court on Friday before Mr Justice Cooper,Patrick Lowery was charged with the theft of 15 head of cattle, valued at £93 15s, at Kaimai. Mr Hampson appeared for the accused. The evidence for the Crown was similar to that given at the S.M.. Court sitting at Matamata, and which has already appeared in these columns. No evidence was callod for the defence, but Mr Hampson addressed the jury, pointing out that the cattle of Self and accused had been running to-gether, and claiming that the latter had made a mistake owing to the indistinct brand. Accused had been foolish but not criminal. His Honor, in summing up, said that Mr Hampson had made a most excellent address on behalf of the prisoner. After a retirement of about an hour and a-half the jury returned with a verdict of guilty, with a strong recommendation to mercy.
His Honor considered this was a very proper verdict.
His Honor said it was not a case for probation, as the interests of the public must be safeguarded. He would let the matter stand over for a week to allow counsel to call evidence regarding accused's good character
