THE ARROW FLAT AND THE COMPANIES.
Agreement made ana entered into this eleventh day uf September, a d. 1&63, between the Hit or Mias company and the Enterprise Company on t]ie one part, and the several miners of the Arrow b'iat, whose names shall be hereinafter attached hereto, on the other part. To wit: First.—That all persons subscribing to this agreement shall have a right, title, and interest 111 the whole length ol the tail race now being held by the companies aforesaid, and in all extensions thereof, piovided they fulfil the terms hereof. Second.—That all persons subscribing their names hereto shall give their fall assistance towards the construction of the following works, viz.Cutting a new flood race, if required; ereeting a permanent, or rebuilding the present, dam, as may be considered desirable; clearing the present tail race of the companies, extending the same to a given point or points, and doing other works that may be found necessary. Third. —That the companies aforesaid shall be exempt from giving their assistance towards any upward extension of the tail race past the boundaries of their claims; but shall, with this exception, conform with clause second, hereinbefore recited.
Fourth.—That two managers be appointed—one by the companies and the other by the miners subscribing—under whose superintendance all works enumerated in clause second shall be carried out.
Fifth.—That each person subscribing to this agreement shall, for every full share held by him, pay to the companies, or any person appointed by them, the sum of two pounds sterling on striking pa) able gold, or otherwise shall pay five shillings a wetk; such weekly payment to be continued during the working of such claim, unless a sum of two pounds tie at any one time paid in release of such weekly payment. Sixth.—Thai any sum of money to be subscribed by the business people of the Arrow towards facilitating the opening of the tail race for the use of the Flat, shall be for the benefit of the Companies. Seventh. —That if any party dispute having struck payable gold, two assessors shall be appointed—one to be elected by the companies, the other by tiie subscribers hereto—who shall, if the) disagree, appoint a third, whose decision shall be final.
Eighth.—That any person subscribing to this agreement, who shall neglect or cease to assist in constructing the works enumerated in Clause 11., according to the directions of the managers aforesaid, shall, and hereby agree to, submit to a verdict in the Warden's Court for the wages to be paid to a substitute, or for a sum equal thereto. Ninth. —That this agreement, after signature, shall be registered, and deposited in the Warden's office. Tenth.- -That unless 70 names shall be appended hereto, it shall be null and void. I have examined the foregoing agreement, and find it in every way in accordance with the propositions submitted to, and unanimously approved by, the public meeting held on September 10, 1863.
