The Lyell Times. SATURDAY, NOVEMBER 14, 1885.

The plntes, ripplas, and berdans at the Alpine battery, gave 7370zs of amalgam, at the partial cleaning-up made yesterday. The quantity of stone put through, was 290 tons, and the time occupied in crushing since the last general cleaningup, eight days.

The Rev. Mr Spencer,—en route for Nelson, where the meeting of the Diocesan Synod is being held, passed through on Thursday last. When on his return. Divine Service will be held here on Sunday evening the 22nd instant, an 1 next evening (Monday) the rev. gentleman will deliver a lecture as is announced in our advertising columns.

As will be seen by announcement elsewhere, this paper having been purchased by Mr Walter Atkin, formerly foreman on the " Inangahua Herald" staff, the publication passes into his hands from to-day. Under the new proprietary, con siderable alterations and improvements are to be made in it,—some of them being, the increasing of its' size to nearly doubli what it is at present; regular mining reports, (including the Owen district) contributions by outside correspondents, and the addition of a supplement containing a good variety of interesting reading matter.

At the last sittings of the Warden's Oou.t, the following business was disposed of:—Croesus Coy,—application for registration of tunnel; granted: W. burns,—water-race at Irishman's Creek; granted : T. Buddie,—two water-races ; granted : C. Weekes, protection of claim for one month; granted : Dillman and party,—water-race; granted: H. Kelly and A. M'Cloy,—s acre special site at Eight Mile Creek, granted subject to survey, if necessary. Same,—water-right out of same creek, granted : H. Cosgrove, —Residence area at Lyell Creek; adjourned for Commissioner's approval: Alpine Coy.,—water-race out of IrishCreek, and dam site in Lyell Creek: granted. A. Duthett and H. Shaw,—3 months protection creek claim. Granted. W. P. Smith and N. Cacace,—application tor gold mining lease of KH acres situated at Alpine Range, for Commotion Company. Objected to by H. Cosgrove on the grounds that objector had applied for the greater portion of that included in the Commotion application,—on the 10th April, 1882, for the Stonewall Jackson < omp my ; that such application had been heard before Mr Warden Baker, who recommended it for survey; that the survey had never yet been made ; neither had the application been finally dealt with, or

a lease granted. Mr Moynihan appeared for the applicants, and said the ground applied lor by his clients was not quite identical with that claimed by the objector. In any case, however, over two years had been allowed to lapse since the Stonewall Jackson application had been made, and that, he thought, amounted to negligence sufficient to constitute abandonment. YY. P. Smith, one of the applicants, steted that in pegging the ground now applied for, on'y one peg was seen ; and the trenches appeared tilled-up. There were no traces as to the pegs having been maintained. His party had a man engaged working on the lease. From the evidence given, as to the locality and the boundaries of the ground in question, it appeared that the Commotion would encroach very considerably on the Stonewall Jackson. H. Cosgrove, the objector, stated his original application had been adjourned for survey, which had never yet. been made ; had been frequently on the ground, and maintained the pegs. There were old pegs in almost every direction about the locality in question. The \\ arden said that a very long period had elapsed since the hearing of the objector's application; and it was somewhat remarkable, if he placed any value i on it, that no step* to hasten the survey I had been made by him. He was of ; opinion that Cosgrove had delayed too long, and that priority of peggiug could hardly be advanced as a claim to a title in the present case. The Court would take time to consider the matter, and, in the meantime, the survey would be proceeded with.
