(West Const Times). MULDOON i.ND OTHERS V. MKNTKATH. ' This was a motion tor prohibition against the decision of the Resident Magistrate, at Ueefton, on the petition of Mmldoon and others against the return of A. S. Menteath, to the Inangahua County Council. Mr Guinness, and with him Mr Lynch for plaintift, Mr Jones for defendant. After argument, His Honor decided that the Magistrate acted wrongly in giving
his casting vote in favor of Campbell, tin candidate who was declared to be duly elected. Tho Magistrate should, in his (the Judge's) opinion have declartd the election void.
