SUPREME COURT.
■IN BANCO. A sitting of the Supreme Court in Banco was hold yesterday, his Honor Mr Justice Denniston presiding. SHEEHAN v. SHEEHAN'. This was an application under an originating summons in the matter of tho° will of Margaret Bruns (deceased) between Margarot Ellen Sheehan and others and Thomas Sheehan, who was named as defendant. Mr Hamilton, who appeared for plaintiff, said that the matter had reference to certain gifts and legacy willed to children.. He applied for power for one of the children to deliver certain gifts-to her father., : John Sheehan, in trust, and that tho Public Trustee should be appointed guardian of the estates of the children during their minority, and for payment to tbo Public Trustee of pecuniary legacies bequeathed under tho will. °His Honor made an ordor accordingly ESTATE IMPROVEMENTS MATTER. Catherine Maria Stocker applied, under an originating summons, for interpretation under the will of Thomas Bryant Head Stocker (deceased) in regard to the payment of certain improvements, amounting to £ll4, on a property on which she is a life tenant, the point at issuo being whether tho money should be paid out of the. capital of tho estate or out of tho income. Tho trustees, F. S. Stocker and others, included the plaintiff, who had been made a trustee under the will. Mr Alpcrs appeared for plaintiff and Mr Nonvc for defendants. His Honor commented upon the peculiar experience of tho plaintiff being in this case a defendant also.. After legal argument on certain phases of the matter his Honor reserved his decision.
