IN CHAMBERS. Monday. February, 23. Sitting in chambers on Monday morning,'his Honor Mr Justice Denniston granted probate of the wills of Ellen Byron, deceased (Mr Beswick), ■nd James Gardner (Mr Beswick). In re the Chattels Transfer Act and the instrument Conway and another'to Roed and Gray (Mr Duncan), a motion to extend time for registration was granted. , Tuesday, February 24.
Yesterday his Honor transacted the following business: — In the matter of agreement between Emily Jane Wade and Charles Comber, contractor, of Christchurch (Mr Dougall), an order was made for the resting of certain land in the petitioner. -
In re the Infants Act, Mr Anthony, for- Elizabeth Anna Prentice, Slied for an order that William Pat- : Duffy should show cause why a writ of habeas corpus should'not be issued against him to produce _ one Thomas Hallam Eddy, an infant. An order to show cause was granted, the summons to be returnable at the first chambers sitting after fourteen days from the date of service. In the matter of the will of William Dearsley. deceased, Mr Dougall, for Joseph Henry. Dearsley and Charles Leonard-.Dearsley, moved for an order that Alfred Ballen and Joseph Sargeant should be .appointed trustees, and that- leave should be granted to sell certain land. His Honor directed that the matter should stand over for further consideration. In the case of Arthur Ernest Otway (Mr Wright) v. Percy Herman (Mr Anthony), counsel for defendant moved for an order for the extension of time to plead and for an adjournment of trial.. The parties agreed to take certain evidence on commission before the registrar. His Honor reserved judgment and seven days further . time was allowed to file theßefence. TT - . .5 In the estate of Charles Hurst, deceased, Mr Fryer moved .for a motion for directions as to sennee. The motion for services was dispensed with, and the matter was referred to the registrar to report. . Probate of the wills of the following deceased persons, was "wanted Ellen Byron (Mr Beswick) and James wardiner (Mr Cassidy).
AUCKLAND CRIMINAL SESSIONS. [Per Press Association.! AUCKLAND, February 24. At the 'Supreme Court to-day, Frank Messenger denied that he broke into the premises of the New Zealand Boot Company and stole two boots. The jury returned a verdict of guilty, and prisoner was sentenced to twelve months’ imprisonment and two years reformative treatment. • The re-trial of Michael Delaney ou a charge of stealing £26 from the person of an Austrian gumdigger, resulted in a verdict of guilty. Delaney *\yas ordered to be detained for' a period not exceeding two years for reformative treatment. Joseph Williams pleaded not guilty to breaking into a dwelling-house at Remuera on February 4. and stealing articles valued at £4O. The jury returned a verdict of not guilty. Tohi Huitoroa,. the young Native who admitted charges of forgery and , uttering, was reported upon unfavourably by the police, the suggestion being that ho was lazy and unsteady of Ifabits, spending money .in holidayleaking and motor-car riding, and that ifi the past he had giyen trouble because of mischievous actions. The Court admitted the prisoner to probation for a period of three years, on condition that lie abstained from liquor and paid the full costs of the prosecution.
