Guinness appeared in answer to a sum monsfor-havirigbn the 13th lost, obstructed Kilnmr" Street, being a thoroughfare, by tethering two cow* in it,contrary to the Police Ordinance. Mr. Guinness admitted that the eowa belonged t him, l)ut denied having tethered them himself f , authorised any of his family to do so. The case was dismissed. Mr. Chas. Perceval appeared as defendant to a claim for damages for trespass of cattle madf by Joseph Cricks of the Ilarewood Koad, amountim? t,, jei i2s. b Mr. Hall said that be would have to carry out thf law as laid down in the new .Trespass of Cattle Amendment Ordinance, which said that damages were to be recovered to the extent laid down in th fc Schedule annexed to it; but there happened to be no Schedule ; he could not therefore see any remedy that the plaintiff had in this case. Upon the applf. cation of the plaintiff, the case was withdrawn. WARD V. lIOWAnb.--CI.AIM FOX £16 19s. si], The plaintiff claimed £6 17s. 9d. for keep of cattle due to himself and another, and £8 6s. Bd. for keep of cattle due to himself alone, which defenJant admitted; the remainder was made up of interest and other items, which'defendant did-not admit. Th e defendant: also claimed £12 as a set off1 for the loss of a steer which was among the lot of cattle belong, ing to him in plaintiffs charge. Mr. Ward called Mr. Draper to speak as to the custom of the country with respect to the responsibility of persons taking stock on terms. The defendant also called several witnesses to speak to the loss of the bullock. Mr. Hall thought that it would be better to adjonrn the case for a week, in order that the custom of the country might be ascertained how far a person was responsible for cattle put upon his run: without any express agreement. The case was adjourned accordingly till the 24th instant. Several other case 3of no interest were on record. for to-day. Wednesday, January 18th. (Before John Hall, Esquire, K. M.) Richard Harper was fined 40s. and sentenced to> be imprisoned for fourteen days with hard labour in Lytteltnn Gaol for drunkenness, it having been the third time within six months of his being convicted for a similar offence. HONr PARATKNB V. MAKTENE REHO (MAORIES). Damages £100. Mr. Cooper having been sworn as interpreter, the plaintiff and defendant each chosea native assessor. The damages were claimed from defendant for Ins having committed adultery with plaintiff's wife on several occasions within the last five years. The wife admitted the charge; The defendant, however, denied its ever having occurred. Judgement by both assessors, Mr. Hall concurring, was given for the plaintiff—damages £50—in default of payment to be imprisoned in Lyttelton Gaol for tour months. The defendant not having the money went to gaol.
