Provincial Council.

Thursday, May 7th. The Council met at's. p.m. Piesent, —The Speaker and Messrs. Hall, Dampier, J. Bealey, S. Bealey, Barker^ Donald, Ollivier, Davis, Weslenra, Brittan, Blakiston, Waid, iloigk'i, Bray, Fooks, Packer, Thomson. ' Mr- Packer laid upon the table messages from his Honor the Superintendent; No. 1,7 transmitting repot ts from the Captains of the Zittgari and the Highlander on the Timaru roadstead and from Mr. Hewliugs on the adjoining country. No. 18, transmitting a document from the Subwarden of Christ's College, giving leasous for desiring a grant of a sum in aid of building a College. ( ( THE WASTE LANDS BOARD. Mr. PACKcit(iu committee) moved the adjourned consideration of Message No 7, containing" the conesponrienCe between the Superintendent, and the Waste 'Lands Boaid, fin the relation between the Board and the Government. The coirespoudence was then read. Nr. Brittan spoke at some length, narrating the circumstances of the case, and arguing the propriety of the claim advanced by the Waste Lands Board to be allowed legal assistance. He then moved the following resolutions:— That this House having taken into consideration his Honoi's Message No. 7, referring to*the lelations which should subsist between the Government and the Waste Lands Boaid, is of opinion; — 1. That the Wa-te Lands Board is a department of the Government. 2. That the duties of the Commissioners, being in part judicial, it is expedient that in all cases of a judicial character whieli may come before the board, it should, if it shall so require, be furnished with legal advice by the Government; and that, in all cases in which the Commissioners may act in accordance with such advice .alllegal costs incurred in consequence thereof should be defrayed by the ■ Government. , S That, under the circumstances of the case of Hall, v McLean, which has been biought under the consideration of the Council, as there appears every reason to believe that the Commissiontis of the Waste Lands Board acted to the best of their judgment and with perfect honesty "of puipose, this committee is of opinion that the board should be relieved from any expense already incurred in sup* Port of thrt decision Resolutions fand 2 wei-e first consideied. ! deration of the Resolution respecting the reserve for « town site at Talhot I'oiest; Mr. liall m the chair. The following resolution was agieed to: — " That his Honor>the Supeiintendent be requested to make the iol owing ieserv,e, viz., 320 acres of land' ior a town at Talbot Foiest, as described in His Ho or's Message No 8, and the plan therto annexed. S.ich town to be called * Geraldine.'" 'Ihe resolution was repoited and adopted' by the Council. On tho consideration of Message No. 9, referiing . to the Melbourne Agency, a resolution propo.sed by .Mr Packer, was withdrawn by leave, and the discussion was adjourned. Message No. 11 was then read and taken into comideration. It referted to an agreement entered into between the Government and Mr. Banks on behalf ot Me^sis Miles, Kington and Co., of Mcl bourne, for establishing a line of steam communieatinii on the coast of tbe .Province. The clauses of . the agieement were then read and put seriatim After some discussion they wete agreed to with a slight a nendment, a'ld a clause was added, empowering the Government to determine the contract in ease of the «ervice not being .Inly performed. The Resolutions approving of the agreement woie then adopted with the amendments by the Council; and a resolution was put and carried to the effect that it \tras not expedient that any premium on the insutance should'exceed 10 per cent, per annum. The House then'went into Committee on Fuller's Remission of Purchase Moirj Bill; the preamble and clauses of which, hs recommended by the repoit ot the Select Coirmit cc on the Bill, weie agreed to, *nd the Bill was repoited. ■The second leading of the Road Reseives Bill was by leave deferred till Thursday next.
