To the Editor of the Lyttelton Times, Sis, —In your paper of Jan. 28th is a contradiction by James Wylde of a case that was heard at- the Magistrate's Court at Kaiapoi on Jan. 9th, in which ;I was the plaintiff. The action was for the recovery of £10 for damages sustained -by me, by James Wylde of Ohokp Bush stopping the carting from my section of bush there, which, formerly belonged to him, with a right-of-way thereto by agreement (I being the,second purchaser), under the pretence of nn r not fulfilling a promise to make about three chains of road over land that he himself had only permission to use as a road until further notice, such land being purchased from James Wylde by Mr. Sneyd. But the real cause of the dispute was that I denied Mr. Wylde 50 feet of sawn timber at a moment's notice, which I had cut to order for another party, and which I was expecting the drayman to fetch away immediately. On this occasion it was that James Wylde threatened to stop the then only way to the Bush, andTvhich he carried into edcct on the sth January. ■ At the Court, Mr. Brittan said he could do nothing in the matter, as it involved the question of title to land ; and the case was consequently dismissed, the matter of dispute remaining as before ; Jas. Wylde (who in Court did not dispute the right-of-way to the Bush in question) liberally agreejng to allow me to go over a few chains of his pri-r ' vate road to the accommodation road through part of the Bush. As Mr. Wylde is anxious that the public should know both sides of the matter, I have furnished some additional particulars, that were not given in the report of the 17th January. THOMAS EATON, P.S.
