To the Editor of the Lyttelton Times. OIR, —Since you have allowed my name to be paraded in your Journal by Mr. Hawkshaw Percival, in consequence of your inserting my former letter of explanation as an advertisement, which I did not intend, I must beg your permission to say that I am not aware I need the kind and considerate advice and suggestions of that amiable person, Mr. Hawkshaw Percival. I never had the honour to be concerned for him, and never intend ; 1 treat his observations with as much respect as I estimate his efforts to repudiate his contract with Mr. Fawcetl, to which his trespass case applies. It is due, however, to yuu and to myself to add to the facts stated by him, that Mr Fawcett, finding the Heavens prevented my getting over the mountain to attend the Justice Meeting, at Christchurch, on Thursday last, afcd seeing the terrible Mr. Hawkshaw Percival, at once vendor, informant, and witness, with Counsel at his side, and being himself without assistance, requested the case might be adjourned, but tins piece of justice being denied him, and the defendant being without the documents which he had placed in my custody to defend the case before the proper tribunal in such cases, —the Supreme Court, —be was comparatively defenceless; and thus was the case, as Mr. Hawkshaw Percival says, " duly tried," and a penalty inflicted, which I venture to think will not be maintained, and if levied, will undoubtedly become the subject of litigation in the Supreme Court.
