SIR, —In reference to a letter in your issue of the 27th ult., subscribed " Christopher Edward Dampier," and appearing therein under the heading of " Advertisement," as purporting to be a retaining throw off against a " Notice of Trespass," emanaling from me in the case of one Peter Fawcett, of Governor's Bay, I would desire ihe fair play of your giving publicity to the following statement, — a statement, as to the truth of which I have already pledged myself by oath—a statement which I challenge any one in the Canterbury Settlement, or New Zealand generally, either directly or indirectly to repudiate, or prove otherwise than already proved—and a statement which (to say the least of it) is not a little at variance with tbe alleged " real facts"' of the case, as cited byMr. Dampier in tlie letter referred to. May I thus be permitted to state that the said case of " iresnass" was duly tried at Chriatchurch, before a full Bench of Magistrates, on Thursday last, the Ist instant; ihe parties to appear in such having been summoned nine days previous. That the depositions, as there taken and abjudicated on, were sufficient evidence as to the co.nmissioi*of the Trespass, and that the finding* of tbe Court was in accordance : —to wit, a verdict for Plaintiff, with an imposition of a fine with costs. I would also remark that Mr. Dampier (much to my regret, and his client's surprise,) was not lo his word " ready," (although no doubt instructed) '* to defend" the case. In conclusion, I cannot forbear suggesting that if Mr. Dampier intends shaping his future professional career in keeping with b's conduct in this and other similar cases of late, that then it might be advisable to bave some one in readiness,%ible and willing, who could ami would defend him when required, ami who would be found at bis post at the appointed* time—ihe hour of trial. Requesting* your -land iuseilion to this as merely a lair elrolienge of, denial as well as afford in _; an explanation of the trial, which while in esse enjoined upon me the honourable necessity of keeping silence so long.
