SIR, —I am instructed by Mr. Fawcetr, of Governor's Bay, to require that you desist from further publication of the slander upon him and his title, nhiclr for the last three weeks has appeared in your columns as a " Notice," under signature of" Westbv FTawkshaw Percev:il,'' ami for any repetition of which Mr. Fawcettwill hold the publisher of your paper responsible. The facts of the case will be found to be, that upwards of 12 months since Mr. Perceval's authorized agents sold Mr. Fawcett and another (whose interest is now also vested in Mr. Fawcett alone) the section referred to, the terms of which contract were reduced into writing by them, and Mr. Fawcett was let into possession. Mr. Fawcetl, relying on the good faith of the parties, has since built his house upon the property, and made numerous other improvements. He is desirous to complete the purchase, on having a marketable title, and the grant produced. This has been required of Mr. Perceval, but has not been complied with ; it is needless, therefore to say, that until it has been, Mr. Fawcett cannot be advised to complete his purchase, or to pay to Mr. Peicival the purchase money. Mr. Peicival now seeks to repudiate the bargain. I have only to add, that if Mr. Peicival really does consider Mr. Fawcett a trespasser, and thinks proper to commence an action to try that question, I inn already instructed to defend it. I must request, that as some amends for the injury already inflicted on Mr. Fawcett and the title to his lands, you will give this explanation as prominent a rlaoe in your journal aa the slander complained of has already had.
