J. F. SWINBOURNE'S ASSIGNMENT NOTICE is Hereby Given, that in and by a certain deed, bearing date the seventh day of February instant, John Foster Swinbocrne, of Christchurch, in the Province of Canterbury, New Zealand, storekeeper, did bargain, sell, assign, transfer, and set over all his interest of and in the Leasehold Land and Premises of him the said John Foster Swinbourne, fronting upon the Market-place in Christchurch aforesaid, with the Messuage or Dwelling-house and Store thereon, now or late in his occupation as owner thereof. Also, all his Household Goods and Furniture, books of account, debt, sum and sums of money, and all other the personal estate and effects whatsoever and wheresoever of him the said John Foster Swinbourne, unto Henry John Le Cren and Edward Allen Hargreaves, of Lyttelton, merchants, upon trust for the equal benefit of such of the Creditors of the said John Foster Swinbourne, who should execute the said Deed within two calendar months from the date thereof, and the said Deed was executed by the said John Foster Swinbourne, Henry John Le Cren, and Edward Allen Hargreaves, on the day of the date thereof, in the presence of and attested by Richard Wormald, of Lyttelton aforesaid, solicitor, and Jonathan Redmavne, of the same place, his clerk. And Notice is hereby further Given, that the said Deed of Assignment now lies at my office, as solicitor of the said trustees, for the inspection and execution by the several creditors of the said John Foster Swinbourne, and such of them as shall neglect or refuse to execute the said Deed within the time aforesaid be excluded all benefit that may arise therefrom. Swinbourrte's Debtors ALL Persons who stand indebted to the Estate and Effects of John Foster Swinbourne, of Christchurch, are hereby requested forthwith to pay the amount of their several and respective debts to the said Henry John Le Cren and Edward Allen Hargreaves, (he tr«stees,actir,g under the said above recited Deed of Assignment, or to Richard Wormald, of Lytteltou, their Solicitor. And Notice is also hereby Given, lhat in case of non-payment thereof, legal proceedings will be taken to enforce paymentof the same against all defaulters without further notice. Dated this eighth day of February, 1855. By order of the trustees, Richard Wormald, Solicitor. To Storekeepers and others. To be Sold by Pbivate Contract, Under Deed of Assignment, ALL that Quarter-acre Section of Town Land, No. 575, fronting the Market-place, Christchurch, with the Dwelling-house and Store thereon, in the occupation of Mr. John F. Swinbourne. Also, all the valuable Stock-in-Trade and Effects in and upon the premises. The Laud and Buildings are Leasehold for the term of two years from the 24th day of June, 1854, with a purchasing clause at any time during or at the expiration of the term. The Ren! is £40 per annum, payable quarterly. . , The Stock is valuable, and in good condition, the greater portion having been but recently purchased from the best markets. To any party desirous of entering into an extensive and profitable business, with every convenience and accommodation, an opportunity now presents itst'lf.
