RESIDENT MAGISTRATE'S COURT, CHRISTCHURCH.
10th July. Before Capt. Simeon, and Messrs. Phillips, Fitton, and Woolcombe.
Gartner v. Jackson and Bentley. —£lo 11 s. 3d. was claimed for rent, &c, from the defendants, who lately occupied the large range of stables, adjoining the Golden Fleece Hotel, belonging to the plaintiff. The defendants haviug removed, on squaring accounts a difference occurred, Mr. Gartner claiming the above sum, and the defendants a set off exceeding it by a few shillings. Mr. Gartner said he had reserved two stalls for his own horses, and provided food for them, therefore he did not see how he could be called upon to pay for what he had not received. The defendants swore that the food provided was insufficient, and that Mr. Gartner was quite
aware that his horses were being fed with the oaten straw belonging to them. Witnesses were examined on both sides, and the case occupied some time. Jndgment was given for plaintiff for lis. 3d., and the costs divided.
Mr. Worsley was fined ss. and costs, for allowing his goats to wander at large. Treleavan and Wheeler v. H. Stace. —Mr. Prichard on behalf of defendant claimed an adjournment on account of his client having been 40 miles up the country when the summons was served at his house. Adjourned to next Saturday. Mr. Worsley was summoned in five cases ot cattle trespass ; he also begged an adjournmenf upon the plea that the summonses were served so late on the previous day that he had not had time to get his witnesses together. Adjourned to next Saturday.
