TH E NO. 2 SLUDGE-CHANNEL RECREATIONS.
Keouv.ations for the Control and Management of the Main Tail-Race, commonly called I,he “ Kmnava SlndgeCliamtel No. 2," and Registered as Main Tail-race No. 40270, dated Bth January 1880 ; and Terms and Conditions for the Use of the said Main Tail-race, by Persons other than oilier the Holders, as provided hj'section 25 of Part 111, of Appendix D to the Mines Act, 1877, viz.— 1. Prom the number of registered holders (hereinafter called the Trustees) of the Main Tail-race (hereinafter called the Channel) shall bo elected, in manner hereinafter provided, a Committee (hereinafter called the Committee), consisting of live persons, including a chairman, secretary, and treasurer ; but the offices of secretary and treasurer may be held by the same person. 2. There shall bo an annual meeting, at which the following persons shall be entitled to be present, viz., the trustees and any other persons who shall have obtained a right to lease of the channel. At each such annual meeting, a fresh committee and officers shall be elected from amongst the trustees, the same persons being eligible for re-election ; and the accounts and balance-sheet of the treasurer shall be submitted to the meeting, and all other necessary business transacted. All casual vacancies in the Committee shall be Idled up by the Trustees. 3. The first annual meeting shall be held at a time and place to be notified by the Warden; and subsequent annual meetings shall be called by the chairman, on some date between the 15th and the 30th of J une in each year. 4. Meetings of the Trustees and of the Committee shall be held at such times as shall have been determined by resolution of the Trustees, but may be called at any time by antbority-of the chairman, upon giving reasonable notice to the members. 5. At any meeting of the Trustees, five persons, and at any meeting of the Committee, three persons, shall form a quorum ; and the chairman, or acting acting chairman, shall have a casting as well as a deliberate vote. G. The Trustees shall keep an account at some bank, which shall be styled “The No. 2 Slndge-channel Account,” and proper books of account shall be regularly kept and audited, and a balancesheet submitted to the annual meeting. All fees and moneys received shall be paid to the said account at the bank. 7. The fee payable for the use of the channel shall be at the rate of ten shillings per week for each man working in a claim connected with the channel; and four hours’ use of the channel for sluicing shall be considered to bo equivalent to one day. The rate of foes payable shall not be altered, except upon a resolution passed at an annual or extraordinary meeting of the Trustees. 8. No tail-race not duly registered under the laws relating to gold-mining fur the time being shall be connected with the channel fur the purpose of sluicing therein. And no tail-race whatever shall (except as hereinafter provided) be so connected with the channel until the ‘holders thereof shall have obtained from the chairman a written permit to use the channel by means of such tail-race, subject to these regulations. !). The grade of the boxes in any tailrace connected with the channel shall not exceed 1.) inches in every 12 feet; but extra fall may be allowed for a distance of 50 feet below' a jump-up. 10. No tail-race shall be connected with tlie channel until the angle of entrance and the timbering of the tailrace have been approved by the Com.mittee. And no timber shall bo removed from any tail-race within a distance of at least 10 feet from its junction with the channel. Tl. Whenever notice is given of the channel being blocked, all parties shall immediately block their boxes. Any party ullending against this regulation shall pay for every such oilenee a line of such amount as the Committee may impose, but not exceeding £5. 12. The Committee shall have power to stop any party from sluicing into the channel if all fees due are not paid monthly'. 13. No purchaser, assignee, or transferee of any share or interest in any claim or tail-nice, shall acquire thereby any right to use the channel until all arrears of moneys due from the party holding such claim or tail-race, or from the vendor, assignor, or transferror of such share or interest shall have been paid. 14. Applications to sluice into the channel shall be dealt with and decided by a meeting of the Trustees ; but the number of tail-races to lie connected with the channel shall not exceed twelve, unless at, least two-thirds of the whole number of Trustees slitill I>o in favour of the increase. And no such increase shall in any case be made unless notice of the intention to propose, such increase shall have been given to each of the Trustees fourteen clear days before the day of meeting. 15. So long as the number of tail-races connecting with the channel shall not exceed twelve, nothing in these regulations shall hinder the Warden, if he shall be of opinion that any application to sluice into the channel has been unreasonably refused by the Trustees from granting to the applicant a registered right to a tail-race ; ami such right shall confer the privilege of sluicing into the channel, subject, however, in all other respects to these regulations.
