Channel No. '_'," and Registered as j Main Tail-race No. 46270,'dated Bth | January 188 G ; and j Terms and Conditions for the Use of the ( said Main Tail-race, by Persons ! other than other the Holders, as pro- j vidod by section 25 of Part 111. of | Appendix D to the Mines Act, 1877, \ viz.— j 1. From the number of registered •, holders (hereinafter called the Trustees) j of the Main Tail-race (hereinafter called , the Channel) shall be elected, in manner ! hereinafter provided, a Committee (here- , inafter called the Committee), consisting j of live poisons, including a chairman, ! .secretary, and treasurer; but the offices • of .secretary and treasurer may be held by the same person. 1. Tliere sluill bo an annual meeting, i at which the following persons shall be ' entitled to be present, viz., the trustees and any other persons who shall have ootained a right to lease of the channel. At each such animal meeting, a fresh j committee and officers shall be elected j from amongst the trustees, the same per- ; sons being eligible for re-tlection ; and the accounts and balance-sheet of the j treasurer shall be submitted to the meet- I ing, and all other necessary business j transacted. All casual vacancies in the i Committee shall be ailed up by the Trus- \ tees. ' 3. The first annual meeting shall be \ held at a time and place to be notified by j the Warden; and subsequent annual | meetings shall be called by the chairman, | on some date between the 15th and the ! 30th of June in each year. : 4. Meetings of the Trustees and of the | Committee shall be held at such times as ; shall have been determined by resolution j of the Trustees, but may be called at any time by authority of the chairman, upon giving reasonable notice to the members. 5. At any meeting of the Trustees, five persons, and at any meeting of the Committee, three persons, shall form a quorum ; and the chairman, or acting acting chairman, shall have a casting as well as a deliberate vote. (i. The Trustees shall keep an account at some bank, which shall be styled "The No. 2 Sludge-chaunel Account," and proper books of account shall be regularly kept and audited, and a balancesheet submitted to the annual meeting. All fees and moneys received shall be paid to the said account at the bank. 7. The fee payable for the use of the channel shall be at the rate of ten shillings per week for each man working in a claim connected with the channel; and four hours' use of the channel for sluicing shall be considered to be equivalent to one day. The rate of fees payable shall not be altered, except upon a resolution passed at an annual or extraordinary • meeting of the Trustees. j 8. No tail-race not duly registered under the laws relating to gold-mining for the time being shall be connected with the channel for the purpose of sluicing therein. And no tail-race whatever shall (except as hereinafter provided) be so connected with the channel until the holders thereof shall have obtained from the chairman a written permit to use the channel by means of such tail-race, subject to these regulations. '..>. The grade of the boxes in any tailrace connected with the channel shall not exceed '.) inches in every 12 feet; but extra fall may be allowed for a distance of i)0 feet 'mlow a jump-up. JO. No tail-race shall be connected with the channel until the angle of entrance and the timbering of the tailrace have been approved by the Committee. The Committee shall have power to stop any party from sluicing into the channel if all fees due are not paid monthly. 13. No purchaser, assignee, or transferee of any share or interest in any claim or tail-race, shall acquire thereby any right to use the channel until all arrears of moneys due from the party holding such claim or tail-race, or from the vendor, assignor, or transferror of .such share or interest shall have been paid. 14. Applications to sluice into the channel shall be dealt with and decided by a meeting of the Trustees ; but the number of tail-races to be connected with th : i;::.iii:iei shall not exceed twelve, unless a;, Last two-third.> of the whole number of Tru.-i...
