WARDEN’S COURT.

Friday, July 9. [Before J. Giles, Esq., Warden.] APPLICATIONS. The applications of Wm. Mom's and others and Henry Richards and others to construct tail-races to connect with the sludge-channels were again postponed. Rudolph Netzband applied, by his agent Mr Jones, to register a branch race to convey water for mining purposes from the Government branch race, No. 47644, near the flushing shaft of the sludge-channel, to the west boundary of Alex. Reid and party’s claim. The length of such race is 22 chains, or thereabouts, and its intended course is north-east, over Rice and party’s, Moore and party’s, passing Gregg and party’s and Reid and party’s claims, also through Meade and party’s claim.— Mr Jones appeared in support of the application.—The application was objected to by a large number of parties, and by Mr D. Hannan, on behalf of Meade and party, for the following reasons:—First, That the granting of same wonld be injurious to Meade and party as it would prevent them from working a strip of 50ft. wide across their claim, and because they have an ownership in the race as it now stands. Secondly, That if the right to this race, which was constructed at the joint expense of the Government and several claimholders, be vested in the applicant, be (applicant) would be getting a private right to the same to the detriment of others as well as themselves who get water therefrom. Thirdly, That the applicant did not require the use of the race through his claim, inasmuch as applicant’s claim is situate above theirs, while he (applicant) sought to register several chains below. Fourthly, That Messrs Isbester and party, M‘Masters and party, and Thomas and paity, sought to register this race for the Goverament, when the present applicant, several other parties, and they (objectors) themselves opposed the application, which was refused. Fifthly, That the present race manager, Mr Band, made an application to register the race, which application was objected to by others and also by themselves (the objectors), who, after their objections had been heard, had withdrawn their application so far as it affected their own claim. And, lastly, Because a petition was presented to the Minister of Mines, when lately in Kumara, in favour of the Government taking over this race and registering it, and that they (the objectors) waited on the Minister at the same time, in presence of the petitioner, and opposed any steps being taken to register through their claim, and that they had since then ascertained that the Government declined to register the race.—The Warden adjourned the Court, and visited the ground, and after hearing argument, refused the application, without prejudice to its being renewed in more correct form, and with fuller statement of the t;'ue object and intention of applicant. Denis Hannan, Legal Manager for Long Tunnel Company, applied for a special site for stacking stones at the Shamrock Lead.—Granted. The same also applied to construct a tramway at the junction of Nicholson’s tramway with the new road, near Pearce’s house.—Granted. Henry Richards and two others applied by th&ir, agent Mr Hannan, for six weeks’ protection for their claim at Larrikins, pending the construction of a tail-race.—Granted.
