SUPREME COURT, HOKITIKA.
CIVIL JURISDICTION. [Before his Honor Chief Justice Prendergast.] Saturday, April 18. His Honor took his seat on the Bench at ten a.m. HUGHES V. THE VICTORIA INSURANCE COMPANY (LIMITED.) This was an action to recover the sum of £275, amount of policy of insurance on plaintiff's property at Rutherglen, destroyed by fire in October, 1883. The defence was that the claim was fraudulent. Mr Stringer for plaintiff, Mr Purkiss for defendants. Plaintiff stated the loss he had sustained. He said that he complied with all the conditions, and that his insurance amounted in the aggregate to £475. A large number of witnesses were examined, and, after addressrs by Counsel, the Court adjourned at seven o'clock until 10 a.m. on Monday, when his Honor would give his decision. Monday, April 20. His Honor this morniDg, after going carefully through the whole of the evidence given on both sides and commenting thereon at considerable length, gave judgment for the defendants on the issue, which alleged a fraudulent concealment, of goods by the plaintiff, with costs to be taxed.
