An important judgment was delivered in the Supreme Court, Wellington, on the 16th inst., by Judge Richmond in the case of Wilberforce v. the Try-again Goldmining Company. This was an appeal upon a case stated by the Resident Magistrate at Wellington, the question being whether forfeiture of shares under section 54 of "The Mining Companies Act, 1872," is absolute on non-payment of a call within 21 days after its due date, and in default of the Company taking effectual proceedings for its recovery within the period limited by the Act. His Honor decided that though the Company loses its right of action for a particular call by not suing within the time limited, yet it is optional with the Company whether the shares are thereby forfeited, and that the Company can therefore recover subsequent calls.
