ATTENTION haying been directed' to the fact that there are a number of persons .(especially Chinese) Mining for Gold within the County of Grey and Kumara Mining District who are not the holders of “ Miners’ Rights,” or who Bights” which have expired, the following extracts from “The Mines Act, J 877,” are py.blielj.ed for general information. Warden’s Office, Greymouth, 31st July, 1880. THE MINES ACT. PENALTIES. 172. Any person not being the holder of ja miners’ right, license or lease, duly empowering him in that behalf, who shall mine for gold or occupy or carry any business upon any Crown lands shall be liable to the penalties following—that is to say:—For the first offence, a sum not exceeding five pounds; for the second or any subsequent offence, a sum not exceeding ten pounds nor less than five pounds, with imprisonment in some gaol, there to remain for any time not exceeding one calendar month for every five pounds or fractional part of five pounds so to be pud; Provided always that in any case where a miners’ right or business license may have been lost or destroyed and the existence of such right or license can bp proved, it shall be lawful to issue to such person a duplicate of such miners’ right pr license in lieu of and comprising the like rights and privileges of such lost or (destroyed right or license, until the due pxpiration of the same, and for which the fee of one shilling shall be paid in case miners’ right and five shillings in the case ja business license, smd a statutory declaration shall in all such cages be pmde as tp Identity and the facts of the case. 173. Any person who shall knowingly mine or employ any person to mine for gold on any land belonging to a private individual, without the consent of the , pwner thereof or his duly authorised agent, phall be subject to the l|ke penalties as are mentioned in the last preceding clause. 174. If any person shall forge or alter jmy miners’ right, license, lease or other document issued under the authority of this Act with intent to defeat the provisions of this Act, or to defraud any persons whomaover, he shall be guilty of a misdemeanour, and on conviction thereof before any Court of competent jurisdiction shall be subject to a fine not exceeding pne hundred pounds, or imprisonment with or withput hand labojf not exceeding three years, or bom, at me discretion of tiie Courjb. 175. If apy person shall use or exhibit pny forged miners’ right, license or lease, Issued orpurporting fo be issued under the authority of this Act, knowing the same to be forged, or if any person shall fraudulently personate the holder of any such puners’ right, license or lease, shall falsely pr fraudulently represent that any servant pr other person is an authorised person within the meaning of this Act, or shall fraudulently use or exhibit as his own any miners’ right, license or lease, belonging tp or granted to any other person, or shall use or exhibit as valid a miners’ right, license or lease, which shall have expired, he shall be liable to a penalty for every pffence not exceeding fifty pounds, or to imprisonment with or wjthout hard labor, pot exceeding one year, op bpth, at she discretion of the Court.
