IN THE WARDEN'S COURT OF KUMARA DISTRICT, in the colony of New Zealand; between Richard Roth well, Thonias Roth well, Nathan Rothwell, Thomas Levit, and William Seater, piaintiffs < and Williacil Corlett, William Reidj Denis Guinney, Jeremiah Patrick O'Leary, Andrew Edward Bohen, and David Beattie> defendants. VTOTICB is hereby given that the IN defendants PATRICK O'LEARY and ANDREW MITCH EL cannot be' found, and that copies of summonses requiring their attendance at the •Warden's Court, to be holdeu at Kiwi* ara on the Sth day of February, 1882, to answer the plaintiffs' complaint, who' sue the defendants' for—lst, That they are the registered owners of tunnel; number certificate 6992. 2nd, That they have abandoned the said tunnel; and that the same has not been used nor occupied for moie than the space of one calendar mouth. 3rd, That the' plaintiffs, with the consent of the defendants William Reid, William Corlett, and Thomas Whinnery took possession of said tunnel, and expended in labor in same thirty-six pounds (£36) together with material valued at five pounds seventeen shillings and sixpence (£5 17-s 6d). 4th, That afterwards other of the defendants refused to allow plaintiffs to retain possession of the 1 said tunnel or reap any benefit for the expenditure of their labor and capital. Wherefore, the plaintiffs pray—lst, That certificate No. 6992 be cancelled ] 2nd, That defendants be ordered to forfeit and surrender said tunnel, and that plaintiffs be declared first applicants for same; 3rd, That defendants be ordered to pay the sum of forty-one pounds seventeen and sixpence (£4l 17s6d),orsuchotherorderbemadeheieirt as the Court may deem fit—has been left for said defendants Patrick O'Leary and Adrew Mitchel at the mouth of tunnel No. 6992, in the presence of Thomas Levit, on the 31st day of Januarv, 1882.
