IN THE WARDEN'S COURT OF KUMARA DISTRICT, in the colony of New Zealand ; between William Morris, aud Thomas Moynihan, Plaintiffs; and Patrick Morau, John Boarke, Patrick Quealey, Peter Gilmartin, John Cieary, Defendants. NOTICE is hereby given that the defendant PETER GILMAUTIN, is the above cause, couid not be found, and that a copy of summons requiring his attendance at the Warden's Court, to be holden at Kumara on the 10th day of November, ISBI, to answer a complaint—that the said defendants claim to be the holders of an ordinary claim on Dunedin Plat; and Ist, That the land so held by the defendants was not at the lime of taking possession of the same marked as required by law ; 2ud, That since that and this day 26th October, 1881, the said claim is not marked as required by law, nor have the marks that were made been maintained as by law required ; 3rd, That defendants, if entitled to any, do occupy a larger area of ground than by law they are entitled so to do. The plaintiffs therefore pray Unit the defendants be ordered to forfeit and surrender the ground illegally held under allegations one and two of tlrkstatement, and that plaintiffs be put in possession of so much of said ground as by law they are entitled (o hold ; 2nd, That should the Court hold that defendants are in legal possession, then that any surplus ground be forfeited and granted to plaintiffs and marked from the defendants two northern boundary pegs ; not to include defendants' shaft or works. Or, that the Court make such other order therein as it msty deem fit has been left for such defendant at the claim aforesaid, in the presence of George Vovsoy on the 7th day of November, 1881. Rowley, and William Llewellyn Richards, Defendants. 11 defendants WILLIAM LLEWELYN RICHARDS, in the above cause, could not be found, and. that a copy ot summons requiring his attendance at the Warden's Court, to be holden at Kumara on the 10th day of November, 1881, to answer a complaint— that the defendants are the Registered owners of a machine site, Certificate No. 7024, and Ist, That the fcaid machine site has not been used or occupied for the purposes for which the same was registered ; 2nd, That the said machine site has been wholly unused and abandoned ; 3rd, That the defendant William Llewellyn Richards has abandoned his interest in machine site No. 7024, and failed to represent his share in same, he having left the district ; 4th, That the land comprised within the boundaries of machine site No. 7024 is auriferous, and plaintiffs desire to work the same. Plaintiffs therefore pray—lst, That the said certificate be cancelled and the ground forfeited and surrendered; 2nd, That the plaintiffs be placed in possession of the said ground, or the Court make such other order therein as it may deem fit has been left for such defendant at his last-known place of abode, his house situate near the aforesaid machiue site, in the presence of George Clapton, on the 7th day of November, 1881.
