[to the editor.] Sir—Mr Simmons in his letter published last evening says that he has sent in his lesignation as Councillor solely for the purpose of saving expenses, and not on account of any doubts as to his being entitled legally to sit at the meetings of the Council. Now, sir, as the Borough Council have already incurred the necessary expenses to test that point. I think it would be far more satisfactory to the ratepayers if
the matter was proceeded with and a legal judgment given on the question in dispute. Perhaps, then, Mr Sminions may not be ousted from office, and the town will be saved the expens* S of an election which will amount to twice or three times the expenses in the R.M. Court. If the Council accept the resignation, it will look as if Mr Simmons did hold his seat legally and had been Illegally forced to i’esign. R T taly 14, 188 L
