Government Notices. STANPINfI REOUL ATION3 RESPECTING AGRICULTURAL XBASES UNDER " THE MINES ACT, 1877." Heroolbs Ropinson, Governor. THEREAS by the fifty-first section of •"The Mines Act, 1877" (herein referred to as " the said Act"), it is enacted that; it shall be lawful for the Governor, subject to the provisions of the said Act bom' time to time to. make, alter amendand rvoke roles; and regulations for all or aayt of the purposes thereinafter enumerated: and.whereas by the fifty-third section of the aaid Actlt ia enacted that the rules and regulations contained in the Appendices to the said; Aetshall be deemed to be the first rufesaiiid: regulations made under the fiftyfirst: and. fifty-second sections of the said Act: And whereas it is expedient that the regulations respecting agricultual leases nflder Appendix B to the said Act, and numbered three, five, ten, twelve, thirteen, fifteen, and eighteen, should be amended i Now,' therefore;!; Hercules George Robert RobihsionV Governor of the Colony- of New Zealand, do hereby order that the regulations under . Appendix B particularly refer^,,fyabpve shall be and are hereby revoked, and the, following substituted in WHO MAY APPLY, 3 application must be made by the applicant in'perßph « and- the Warden shall not' entertain 1 any application unless he satisfied, that the person is of the full age of twenty,-one-years, and , legally capable of being,, bound ( by the contract into which it ithereby proposed to enter, and is not in respect of the land applied for, or in respect of any part thereof, the agent or servant of or aitriuabeftfor any other person. Objections that the the applicant is nofrof thd full age of twenty-one yews, of tbatfhe is in respect of the land applied for the agent or servant of or the trustee for any other person, or that the whole or any portion ot the land applied for is claimed or owned by any other person than the applicant, or is in the whole or in part auriferous, or is r or is likely to; be, required for any public purpose, must be made in writing to the Warden, and lodged at the office at which the application Bhall have been lodged twenty-four hours at least before the time appointed for hearing; and the person objecting must at the time appointed for hearing- urge the objeotion personally, or by ounsel or agent. 10. At any time before finally dealing with any application the Warden may require a report or survey to be mvie by the District Surveyor, and in such case the cost of such survey or report shall be paid in advance to the Receiver of Gold Revenue either by the applicant or the objector, or partly by both, Mihay be decided by the Warden. ■ ■■■'■'■&'. i.' On issuing any certificate the Warden «h*tt> forthwith forward to tho Governor a .duplicate .of,such certificate, and notwithstanding the issue of the same, it shall be from the date thereof to refuse to grant it the applicant a lease of the land referred to in; such .certificate; and immediately upon Bitch., refusal being communicated to the applicant, either personally or by letter ad* dressed to him at his usual or last: known place, of bnsiness or abode, the certificate and matter and thing therein contained shall become and be absolutely void, and the applicant shall forthwith quit and deliver ap possession of the said land, and failing his so doing he may be proceeded against as a trespasser on Crown lands. CONDITION OF OCCUPATION. 12. Every certificate and lease shall b« subject to the conditions following, that is to say—1. That no- sale or assignment shall be made without license. 2.. That mot leas than one-eighth, of the whole area Bhall be cultivated,, or, if timbered land, cleared, within- twelve month* aftev. the commencement of the, or, one-fourth of the whole are* substantially fenced within the same time. 2. That the lessee shall, within two years after the commencement of the term; :eredt[ a- dwelling-house of a value of not. less, than fifty pounds sterling, and that' within the. dame period lie shall begin- to reside on the land; and continue so to do until the land becomea freehold.
