STAN DING REGULATIONS RESPECTING AGRICULTURAL LEASES UNDER “ THE MINES ACT, 1877.” Hercules Robinson, Governor. r HEREAS by the fifty-rfirst section of “ The Mines Act, 1877” (herein referred jto as “ the said Act”), it is enacted that it shall he lawful for the Governor, iubject to th'e provisions of the said Act ffomtime to 'tune to make, alter amendahd ryoke rules and regulations for all or <-aoy!of Hie purposes thereinafter enumerated: andwhereaaby the fifty .third section of the said Act it is enacted that the rules and -Hegnlafeibns: contained in the Appendices to jthesMdAet shall be deemed to be the first des and regulations made under the fifty* fifty-second sections of the said |nd whereas it is expedient that the respecting agricultual leases ndiz B to the said Act, and /three, five, ten, twelve, thirteen, , and eighteen, should be amended t New*'there fore, I, Hercules George Robert Robinson, Governor of the Colony of New f ZealmM,;do hereby order that the regnla* ~tbns . under Appendix B particularly re* lerred to above Hiall be and are hereby reVdked, and the following substituted in lieu thereof:— m* WHO MAY APPLY, 3. Every application must be made by the m persOn; and the Warden shall -6ot' entertainany application unless he csfetisficd that the person is of the full age of fig* I ** e&r8 * anc * loyally capable of bound by the contract ixifco which it .thereby proposed to enter, and is not in respect of the land applied for, . or in respect of (any i part .thereof, the agent or servant of pr a trustee for any other person, OBKOTIONS. 6. Objections that the the applicant is 'not of the fall age of twenty-oneyears, of . that he is in respect of the land applied for . the, agent or servant of or the trustee for ; atiy other person, or that the whole or any /ration of the land applied for is claimed or ' Wwhed by any other person than theappli- - bUrit,or is in the whole or in part anriferous, . or js or is .likely to be required for any , public purpose, must be made in writing to ' the'Warden, and lodged at the office at which the application shall have been lodged _ twenty.foar hours at least before the time appointed for hearing; and the person objecting : must at the time appointed for hearing .urge the objection personally, or by ounsel or agent. 10. At any time before finally dealing with any. application the Warden may require a report or survey to be made by the District Surveyor, and in such case the cost of such , survey, qr report shall be paid in advance to the Receiver of Gold Revenue either by the applicant or the objector, or partly by both, r As may be decided by the Warden, GOVERNOR'S POWER TO BEPOSK LEASE RI SERVED. 13. On issuing any certificate the Warden .; shall forthwith forward to the Governor a duplicate of raoh certificate, and notwitb* ' standing this issue of the same, it shall be lawful for the Governor within sixty day ' from the date thereof to refuse to grant it : the npplicanta lease of the land referred to such, certificate; and immediately upon ’such refusal' being communicated to the applicant, either person ally or by letter ad- " dressed to hito at his usual or last known place of business or abode, the certificate . and metier and thing therein contained ■hall become and be absolutely void, and the applicant shall forthwith quit and delivei up possession of the said land, and failing his bo doing he may be proceeded against at a trespasser on Crown lands. CONDITION OF OCCUPATION. 12. Every certificate and lease shall b» subject to the conditions following, that is totay— I, That no sale or assignment shall be made without license. 2» That not less than one-eighth of the . whole area shall be cultivated, or, if timbered land, cleared, within twelve ■ months after the commencement of the, or one-fourth of the whole area substantially fenced within the same time. r . 2. That the. lessee shall, within two years after the commencement of the . . term, erect a dwelling-house of a value of not less than fifty pounds sterling, and that within the same penodne shall begin to reside on the - '-'land, and continue so to do until the landbecomes freehold.
