ATTENTION havingi been greeted to the fact that there are a number of persons (especially Chinese) Mining fpr Gold within the County of Grey and Kumara Mining District who are riot -the holders' of'" Miners' Rights," or who are holding u Miners' Rights" Which have expired, the follow-, ing extracts from "The Mines Act, 1877," are pdblitHed for generaUinformation. Warden's Office, Greyniouth; 31st July, 1880. ; THE MINES ACT; '." PENALTIES. 172. Any person not being the holder of a miners' right, license or lease, duly empowering hith in that behalf, who shall mine for gold or occupy or carry any business upon any Crown lands shall be liable to the penalties following—that is to say -.—For the first offence, a sum not ex-! ceeding i&ve pounds; for the second or any subsequent offence, a sum not exceeding ten pounds nor less than five pounds, with imprisonment hi some,gaol, there to remain for any time not exceeding calendar month! 1 fpr every five, pbjmds or fractional part of five 1 pounds'so' to bej paid; Provided always 5 that in any case] where a miners' right or- business license! may have been lost or destroyed.and the: existence of suchright or proved, it shall be lawful to issue to such! person & duplicate of such miners' right! or license in'lieu of and. comprising like rights and privileges of ;! Any person who shall kndwinglyj mine or employ any .person \o mine "for! gold on any land belonging to a private' individual, without of the' owner thereof or his duly authorised agent, shall be subject to the like penalties as are mentioned in the last preceding clause. 174. If any person shall forge or .alter any miners' right, license, lease or other document issued under the authority of this Act with intent to defeat the provisions of this .Act, or to ;defraud any persons whomsover, he shall be gnjlty of. a misdemeanour, and on conviction thereof before any Court of competent jurisdic-i tion shall be subject to a fine hot exceeding one hundred pounds, or .imprisonment with or without hard labor not exceeding three years, or both, at: the discretion of! the Court. . , 175. If any person shall use or exhibit any forged miners' right, license or lease, issued or purporting to be issued under the authority of this Act, knowing the same to be forged, or if any person'shall fraudulently personate the holder of any such miners' right, license or lease, shall falsely or fraudulently represent that any servant or other person is an authorised person within the meaning of this Act, or shall fraudulently use or exhibit as his own any miners' right, license or lease, belonging to or granted to any other person, or shall use or exhibit as valid a miners-' right, license or lease, which shall have expired, he shall be liable to a-, penalty for every offence not exceeding fifty pounds, or to imprisonment with or without hard labor, not exceeding one year, or both, at the discretion of the Court.
