TTENTiON having been directed to the fact that there are a hum her of poisons (especially Chinese) Mining for Gold within the County of Grey and Kumara Mining District who are not the holders of “ Miners’ Rights,” or who are holding “ Miners’ Rights” which have expired, the following extracts from “ The Mines Act, 1877,” are phblhhed for general information. Warden’s Office, Greymouth, 3 1st July, 1880. Tllfe MINES ACT. PENALTIES; ; 172. Any person not being the holder of a miners’ right, license of lease, duly empowering him ih that behalf, Who shall mine for gold or occupy or carry any business upon any Crown lands Shall be liable to the penalties fblidwitig—that, is to say > - ’ —For the first offence, a .Burn not exceeding five .pounds; for the second or any subsequent offence* a sum not exceeding ten pounds nor less than five pounds, With imprisonment in Some gaol, there to remain for any time not exceeding one calehdar nlbilth fof ftvfi p'ofiiids of fractional part bf life pounds sd to paid ■ Provided always that in any case where a;miners’ ri§ht, or business, license may have-been lost di destroyed : a,i]Ld; th. 9 existence of such right or hpehse ckA fi’g proved, it shall be lawful to issue, to such person a duplicate of such miners’ right br license in lielu of and comprising the like rights and privileges of such lost or destroyed right dr-license,, until the due expiration of the same, and for which the fee of dhe shilljfilj shall be paid in case miners’ right and five shillings ih the CaSe a business license, and a statutory declaration Shall in all such cases be made as to identity arid the facts Of the case. 173. Any person who. shall knowingly mine or employ any person td mine for gold on any land belonging td a private individual, without the consent of the owner thereof or his duly.authorised agent, shall Be subject to the like penalties as are mentioned in the last preceding clause. 174. If any person shall forge or alter any mmera’ tight- license, lease oif other document issued riiider the authority of this Act with ihterit to defeat the provisions of this Acty.br to, defraud any persons whomsover, he shall be, guilty of a misdemeanour, and on conviction thereof before ariy Court of competent jurisdiction shall Be subject to a fine riot exceeding oile hundred pounds, of imprisonmeiit with dr Without hard labor not exceeding three years, or both, at the discretion of the Court. ~ 175. If any person shall, use of exhibit any forged miners’ right, license or lease, issued or purporting to be issued under the authority of this Act, knowing the same to be forged, or if any person shall fraudulently personate the holder of any such miners’.right,- license of lease, shall falsely or fraudulently represent that any servant or other persqn is an authorised person within, the meaning of. this Act, of shall fraudulently use of exhibit as his own any miners’ right, license Of lease, belonging to or granted to any other person* or shall Use or exhibit as valid a miners’ right, license or lease,. which shall have eipired, he shall be liable to a penalty for every offence not exceeding fifty pounds] dr to imprisonment with of without hard labor, riot exceeding one year, of both, dt the discretion of the Court: R.
