Auckland, March 25i A ijase ol some importance came before the Supreme Court* on demur, O'Halloran v. Ahipeuej The plaintiff advanced defendant money upon a contract to purchase land before its " vesting in freehdld tenure" which was held to be illegal. Plaintiff sued defendant (a native) to recover the money; It was contended that the money could be recovered so long as the contract was merely executory and not for any immoral purpose* although it might ba technically illegal. Counsel for defendant argued a contract made 1 in direct contravention of a statute framed to restrict snch contract was wholly void, and that the money could not bo recovered, The decisions went on a minor point, but the action will probably be tried at the next civil sittings of the Circuit Court.
