The company repudiate the policy on the ground of violation or one of the conditions, whicii waa to the eilcct that the amount would not bo recoverable in the event of the property being subsequently insured in any office without notice beiim given, so that they might have : >n opportunity ot terminating their insurance if they wished. White stmd the South British Company at Kelson for the amount, less .£SO, so as to give the Court juiisdiction. It was proved By the defendants that two other policies in another office, to the amount, of .£450 in all, had been taken out by plaintiff on same property befoio the date of the South British policy had expired; ami the Court gave judgment for defendant. White appealed against this on the ground that such a regulation of the company as that Inferred to was uncalled for and unnecessary, and that the .£7OO insured was not above the value of the property.
